"Due Process" Openly Negated in the USA

"Due process is the legal principle that the government must respect all of the legal rights that are owed to a person according to the law. Due process holds the government subservient to the law of the land protecting individual persons from the state. When a government harms a person without following the exact course of the law it constitutes a due process violation which offends against the rule of law…

"Due process developed from clause 39 of the Magna Carta in England. When English and American law gradually diverged, due process was not upheld in England, but did become incorporated in the Constitution in the United States…

"In clause 39 of the Magna Carta, John of England promised as follows: "No free man shall be seized or imprisoned, or stripped of his rights or possessions, or outlawed or exiled, or deprived of his standing in any other way, nor will we proceed with force against him, or send others to do so, except by the lawful judgment of his equals or by the law of the land."

"Due process under the U.S. Constitution restrains the executive and judicial branches, but additionally restrains the legislative branch."

In the unlimited detention without trial that began under "W," which included detention without trial of citizens of Canada and United Germany -- both NATO countries -- as well as the deaths (usually by beating and bludgeoning) of at least 101 unarmed prisoners (mostly in Iraq), we have moved to the assassination of a foreign national on foreign soil without a trial or a military court martial (Osama bin Laden's "hit" this year), to the assassination of a U.S. citizen by direct presidential order (Alwar Al Awlaki three days ago). No arrest. No warrant. No detention. No trial. No rule of law. A "hit" of an American by its President.

Below are links to three articles that clearly describe this retreat by America from rule of law and due process.

The first is about the Obama "hit"

The second details a failed attempt on Al Awlaki early in May

The third summarizes the successful attempt on Al Awlaki a few days ago.

CONCLUSION

No American in this nation's history has moved this country closer and faster to dictatorship than Barack Hussein Obama.

AFTERWORD

The Islamic terrorists are slowly and steadily winning.
